Schwab Record & Media Cabinets, Record & Media Safes And Vault Doors - Limited Lifetime Replacement Warranty
Lifetime Fire Replacement
In the event that this record/media cabinet or safe is damaged by fire while in the possession of the original purchaser as shown on the warranty registration card, Schwab warrants that it will replace the product free of charge; however, all freight costs are to be borne by the purchaser.
Parts Warranty
If a part manufactured by Schwab fails or malfunctions, while in normal use as a result of defects in materials or workmanship, Schwab will repair or replace, at Schwab’s option, said part free except for shipping and handling charges for a period of one year for record/media cabinets and three years on safes and vault doors.
Labor
Schwab will furnish the labor cost for replacement of such parts when approved in advance by Schwab for a period of one year from date of purchase. All such labor charges must be authorized in advance by Schwab in writing. All labor will be performed at service centers or by service providers designated by Schwab.
Parts Manufactured by Others
Schwab does not warrant any product, components or parts manufactured by others, such as locks and closers; however, to the extent that the manufacturer provides a warranty and the warranty is assignable, Schwab hereby assigns that warranty to the purchaser.
Vault Door Limitations
Vault doors are not intended for outdoor use. Rust caused by storage in such a manner to allow the door to be exposed to water is not covered by warranty. Closer mechanisms furnished with the vault doors are field installed by others. Schwab disclaims any warranty on such installation.
Disclaimer of Warranty
THIS WARRANTY IS LIMITED TO THE TERMS STATED HEREIN. IT IS IN LIEU OF AND SUPERSEDES ANY OTHER WARRANTY WHETHER EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
Limitation of Remedies
In no case shall Schwab be liable for any special, incidental, or consequential damages based upon breach of warranty, breach of contract, negligence, strict tort, or any other legal theory. Such damages include, but are not limited to, loss of profits, loss of savings or revenue, loss of the contents of the record/media cabinet, safe or vault door, loss of use of the record/media cabinet, safe or vault door, or any associated equipment, cost of capital, cost of any substitute equipment, facilities or services, downtime, the claims of third parties including customers, and injury to property. Some states do not allow limits on warranties, or on remedies for breach in certain transactions. In such states, the limits in this paragraph and in the prior paragraph may not apply.
Warranty Registration Card
It is a requirement of this warranty that the registration card showing the serial number of the product and original purchaser information must be on record with Schwab within sixty (60) days of purchase to validate this warranty. Failure to register the product and original purchaser shall void any warranty.
No Other Warranties
Unless modified in writing signed by both parties, this agreement is understood to be the complete and exclusive agreement between the parties, superseding all prior agreements, oral or written, and all other communications between the parties relating to the subject matter of this agreement. No employee of Schwab or any other party is authorized to make any warranty in addition to those made in this agreement.
Allocation of Risks
This warranty allocates the risks of product failure between Schwab and the purchaser. This allocation is recognized by both parties and is reflected in the price of the goods. The purchaser acknowledges that it has read this agreement, understands it, and is bound by its terms
